FAIR USE AND ACCEPTABLE USE POLICY (AUP)

1. PURPOSE AND SCOPE To maintain the structural integrity, security, and high-availability (uptime) of MoraCen LLC’s proprietary Software-as-a-Service (SaaS) platforms, APIs, and data refinery infrastructure, this Fair Use and Acceptable Use Policy ("Policy") strictly governs the parameters of acceptable user behavior. This Policy applies to all users, subscribers, and third-party integrators accessing MoraCen LLC systems globally.

2. AUTHORIZED UTILIZATION MoraCen LLC platforms are engineered for complex operational workflows and data management. Users are granted a limited, non-exclusive, non-transferable license to utilize our platforms and APIs strictly within the computational and bandwidth parameters defined by their purchased subscription tier. Fair use dictates that no single user’s operations should disproportionately consume server resources or degrade the experience of other enterprise users.

3. STRICTLY PROHIBITED ACTIVITIES To protect our infrastructure and intellectual property, users are strictly prohibited from engaging in any activity that compromises our systems. A violation of this section constitutes a material breach of our Terms of Service. Prohibited activities include, but are not limited to:

• Infrastructure Abuse: Deploying automated scripts, unauthorized web scrapers, crawlers, or bots to extract data from our APIs or web applications beyond permitted rate limits.

• Security Evasion: Attempting to bypass, disable, or circumvent authentication protocols, API rate limits, paywalls, or encryption standards.

• Unauthorized Commercialization: Reselling, sub-licensing, or packaging our raw data outputs, analytics, or software tools for third-party commercial use without a formal, written Agency or White-Label Master Service Agreement (MSA) from MoraCen LLC.

• Malicious Operations: Utilizing our platforms to process, host, or distribute malware, ransomware, illegal content, unlawful pornography, or materials promoting extreme violence and terrorism.

• Denial of Service: Intentionally overloading our servers (e.g., DDoS attacks) or engaging in computational tasks designed to artificially inflate bandwidth consumption.

4. API USAGE AND BANDWIDTH ALLOCATION For platforms utilizing our APIs, MoraCen LLC enforces automated rate limiting to prevent server degradation. If your account consistently exceeds the computational thresholds of your tier, or if your usage patterns mimic automated abuse, we reserve the right to temporarily throttle your bandwidth or restrict API calls until the billing cycle resets or the account is upgraded to a higher capacity tier.

5. ZERO-TOLERANCE ENFORCEMENT AND REMEDIATION MoraCen LLC utilizes automated telemetry to continuously monitor infrastructure health. We reserve the unilateral and absolute right to throttle bandwidth, suspend, or permanently terminate any account found to be in violation of this Policy, without prior notice and without eligibility for a refund. In the event that a user's prohibited activities cause measurable financial or operational damage to MoraCen LLC's server infrastructure, we reserve the right to pursue full legal and financial remediation.

6. POLICY MODIFICATIONS MoraCen LLC reserves the right to amend, update, or modify this Policy at any time to adapt to new security threats or infrastructural changes. Continued utilization of our services following any published changes constitutes your legal acceptance of the revised Policy.
